Dealing with individuals with brain injuries is a very important part of our practice at Choulos Choulos & Wyle. Traumatic brain injuries dramatically affect the lives of brain injured people and their families. In many cases, these injuries leave individuals permanently disabled, or in need of months, and sometimes years, of rehabilitation and therapy. Our California traumatic brain injuries (TBI) attorneys want to make sure our injured clients and their families have the resources they need to deal with these drastic changes.

What is Traumatic Brain Injury?

Traumatic Brain Injury (TBI) is a simple term used to describe an array of complex injuries involving varying degrees of impairment to brain functioning. TBI can occur anywhere and anytime, but the highest number of injuries happen as a result of car accidents, workplace situations and falls. Any type of trauma to the head, lack of oxygen, chemical exposure, near drowning or birth related complications can lead to permanent loss of functioning and changes in lifestyle.

A person with even a mild TBI can expect to experience any combination of the following:

  • lack of memory for events right before or right after the accident
  • altered mental states often described as dazed, disoriented or confused
  • amnesia not lasting more than 24 hours after the accident
  • total loss of consciousness for up to 30 minutes
  • Glasgow Coma Scale reading of 13-15 a half hour after the accident.

There is no amount of money that can repair the damage or lessen the consequences that come from these injuries, but since the financial cost of the care that is needed under these circumstances can be huge, large settlements are essential not only to the patient, but also the family and caregivers.

Definition of the American Congress of Rehabilitation Medicine Journal Head Trauma Rehabilitation 1993:8(3)86-7

Traumatic brain injury can result from a sudden hit to the head that causes injury to the skull. It can also occur after an accident or surgery, due to swelling and bleeding into the brain or bleeding around the brain. In addition, traumatic brain injury can result from a “closed head” injury, where there is no obvious sign of damage to the skull, yet symptoms consistent with a brain injury occur.

“Mild” Brain Injuries Are NOT Insignificant

While the medical field can label a brain injury as mild, the truth is there is no such thing as an “Insignificant” brain injury. Headaches, difficulty completing thoughts, problems with memory, lack of attention, mood swings and frustration are just some of the recurring symptoms that come with a Mild TBI diagnosis. These injuries are often overlooked or don’t receive proper compensation because attorneys don’t understand the gravity of the situation and the devastation these symptoms can cause an individual and their loved ones. The recovery process from even a mild head trauma can end up being a permanent routine of lifestyle adjustments and special accommodations for the injured person, family members and home environment.

Sports injuries often fall in this category and are a major cause of TBI’s in America. Any blow to the head from a ball, collision or fall should be taken seriously and an evaluation from a physician should be done as soon as possible.

Our San Francisco brain injury lawyers have years of experience helping clients with head injuries and can provide access to the appropriate medical specialists and experts.
