Accidents for occupants of automobiles may be only fender benders, with no personal injury. In contrast, a California motorcycle accident – helmet or no helmet -- usually results in personal injuries or wrongful death.
Roadways Belong to Motorists . . . . and Motorcyclists
The millions of miles of roadways in California are usually designed only with the safety of automobile drivers in mind. Some roadways may be safe enough for the occupants of automobiles but may pose serious risk of personal injury or wrongful death to motorcyclists. The San Francisco motorcycle accident attorneys of Choulos, Choulos & Wyle have successfully won many trials and maximized settlements for motorcycle riders who suffered personal injuries from dangerous and defective highways, roadways, streets, and intersections.
The cause of a motorcycle accident is not always black and white. CCW looks beyond the oversimplified collision factors in the police report. CCW conducts an independent investigation, going deeper to uncover key factors such as whether another driver, a dangerous road, or a defective product caused or contributed to a motorcycle accident or to the motorcycle rider’s injuries.

Recent Examples of Our Success
$400,000 Settlement for Alameda Motorcyclist
Our motorcycle accident attorneys recently fought for and won a settlement for $400,000.00 for a survivor of a motorcycle crash who suffered serious crushing injuries to, and the eventual amputation of his left foot. This motorcycle accident occurred when an Oakland woman, making a left turn in Alameda, California hit the motorcycle rider as the biker was going straight. The lawsuit was filed in Alameda County, California. The offending driver denied liability, lied about the traffic lights, made up witnesses, and also tried to hide her assets, by taking all of the equity out of her house to make herself appear judgment-proof. Unfortunately our client, an Oakland truck driver, was not insured at the time of the motorcycle accident and he was therefore not entitled, under California Law, to pain and suffering damages. This biker, though, was entitled to his out of pocket expenses such as past and future medical bills, past and future wage loss and the cost of future prosthetics and therapy. Our team of motorcycle attorneys refused to accept defendant's policy limits, and forced this offending driver and her husband to come up with substantial cash out of their pockets to help compensate our client. Sometimes the toughest part of representing the survivors of motorcycle accidents is finding enough insurance or assets to cover serious personal injuries, and this is a great example of what great results a motorcycle attorney can achieve when he is tough, aggressive and smart. This woman and her husband were made accountable for the damages they caused. Another lesson learned is that every driver or rider in California absolutely must carry, at least, liability insurance or they might not be fully compensated, even if they are injured through another driver's negligence.
Marin County Motorcycle Accident Case - 280,0000 Settlement
Our dangerous products lawyers, fought for and won another great result in a Marin County motorcycle accident case. Representing a rider of a dangerous and defective motorcycle against the manufacturer of that motorcycle, our products liability attorneys settled this personal injury case, before litigation, for $280,000. This dangerous product case is particularly notable, since our client, an El Sobrante motorcyclist, had recently purchased his motorcycle in San Rafael, and he sustained serious burns to his legs and buttocks when his newly purchased motorcycle lit on fire as he was riding it.
At the time of the motorcycle fire, the motorcycle rider was on his way to the dealership to fix an undiagnosed problem with the bike. While riding eastbound on Highway 580, just east of San Quentin, the motorcyclist realized that his bike was on fire, when he suddenly felt intense heat rising from below his seat. He was able to slow the bike down somewhat before jumping off the bike while it was still rolling.
This dangerous and defective motorcycle caused this rider 3rd degree burns that literally burned the jeans off his body from his legs to his waist. Although our clients consumer expectations were not met, the manufacturer of the motorcycle did not immediately admit liability. Our team of motorcycle accident attorneys successfully argued and negotiated this consumers claim, and the manufacturer of this dangerous product was made accountable.
