Exploring the scenery of California on a motorcycle or just going about your daily commute can be a dangerous proposition when you have to share the road with negligent drivers. Roadways Belong to Motorists . . . and Motorcyclists

With thousands of miles of roadway in California, some accidents are inevitable. Most, however, could be prevented by attentive driving, properly-designed roads and adequate safety measures. Unfortunately for motorcyclists, roadway engineers typically design roads to cater to automobile and truck drivers; these same roadways may be safe enough for the occupants of automobiles, but can pose a serious risk for personal injuries or wrongful death to motorcyclists. The San Francisco motorcycle accident attorneys of Choulos, Choulos & Wyle have successfully won many trials and maximized settlements for motorcycle riders who suffered injuries caused by dangerous and defective highways, roadways, streets and intersections.

The cause of a motorcycle accident is not always black and white. Our firm looks beyond the often oversimplified reasons listed in the police report. We conduct an independent and thorough investigation, going deeper to uncover key factors such as whether another driver, a dangerous road or a defective product caused or contributed to the motorcycle rider's injuries.

Preserving Evidence after a Motorcycle Accident

After a motorcycle collision, it is vitally important to preserve evidence. Taking some simple steps like taking pictures of the accident scene, documenting your injuries, getting copies of all police and insurance paperwork and getting the contact information of witnesses greatly increases your chances for a successful recovery later.

Left-Handed Turns in Front of Motorcycles

Motorcycle collisions are commonly caused by cars or trucks making left-hand turns into the path of an oncoming motorcycle. Because they are so common, at any given time our motorcycle accident lawyers are handling several left turn cases. Although these accidents are typically caused by negligent drivers, motorcyclists are often blamed. Such phrases as "that motorcycle came out of nowhere," "I just didn't see him," and "he must have been speeding" are commonly uttered by car and truck drivers who caused accidents. An important rule of the road is that the vehicle proceeding straight has the right of way: the vehicle making the left-hand turn has the responsibility to yield.

Our motorcycle accident attorneys understand the dynamics of left turn crashes and have the resources to win these cases and maximize our clients' recovery. We work hard to ensure your right to ride safely.

Successful Results for Our Deserving Clients

$400,000 Settlement for Alameda Motorcyclist

Our motorcycle accident attorneys recently fought for and won a settlement in the amount of $400,000 for a motorcycle crash victim who suffered serious crushing injuries to, and the eventual amputation of, his left foot. This particular motorcycle accident occurred when an Oakland woman, making a left turn in Alameda, California, failed to yield to the motorcyclist and hit him as he was proceeding straight in the lane adjacent to hers.

We filed suit on behalf of our client in Alameda County, California. The offending driver denied liability, lied about the traffic lights, made up witnesses and even tried to hide her assets by taking all of the equity out of her house to make herself appear judgment-proof. Unfortunately our client, an Oakland truck driver, was not insured at the time of the motorcycle accident and he was therefore California law did not allow him to recover damages for his pain and suffering. We were able to prove, though, that our client was entitled to his out of pocket expenses such as past and future medical bills, wage losses and the cost of future prosthetics and therapy.

Our team of motorcycle accident attorneys refused to accept defendant's insurance policy limits, and forced this offending driver and her husband to come up with substantial out of pocket damages to compensate our client. Sometimes the toughest part of representing motorcycle accident victims is finding enough insurance or assets to cover serious personal injuries. The successful result we achieved for this client is a telling example of what great results a motorcycle attorney can achieve when he is tough, aggressive and smart. This negligent woman and her husband were made accountable for the damages they caused.

An important lesson to take away from this case is that every driver and rider in California absolutely must carry, at the very least, liability insurance to ensure their right to full recovery in the event of an accident, even one caused by another driver's negligence.

$280,000 Settlement for Marin County Accident Case

Our dangerous products lawyers fought for and won a great result in a Marin County motorcycle accident case. Representing a rider of a dangerous and defective motorcycle against the manufacturer of that motorcycle, our products liability attorneys settled the personal injury case, before litigation, for $280,000. This dangerous product case is particularly notable, since our client, an El Sobrante motorcyclist, had recently purchased his motorcycle in San Rafael, and he sustained serious burns to his legs and buttocks when his newly purchased motorcycle lit on fire as he was riding it.

At the time of the motorcycle fire, our client was on his way to the dealership to fix an undiagnosed problem with the bike. While riding eastbound on Highway 580, just east of San Quentin, the motorcyclist suddenly felt intense heat rising from below his seat. It was then that he realized that the bike was on fire. Amazingly, he was able to slow the bike down enough to jump off it while it was still rolling.

This dangerous and defective motorcycle literally burned the jeans off our client's body, causing his third-degree burns and intense physical pain. In spite of the obvious issues with the bike, the manufacturer of the motorcycle did not immediately admit liability. Our team of motorcycle accident attorneys successfully argued and negotiated this consumer's claim, and the manufacturer of this dangerous product was held accountable.
